Breach of Contract

When a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other party's performance.

 

Hsia v. Viva Life:

Breach of Written and Oral Contract

Substantial six-figure settlement in an action for compensatory and punitive damages. Defendants were engaged in the international manufacture, sales and distribution of health and nutritional supplements. Plaintiff was instrumental in helping Defendants build a successful multi-national business operation. In consideration for plaintiffs’ efforts and to induce plaintiffs to work for Defendants, Defendants promised to pay plaintiff a percentage of gross worldwide sales throughout the life of Defendants’ business operation, and to grant plaintiffs a percentage equity stake in Defendant’s international business operations. Defendants then refused to pay plaintiffs the agreed upon amounts and refused to deliver the equity stakes that were promised.

 

Chrisaljen v. Yu:

Breach of Contract, Negligent Misrepresentation

Favorable six-figure settlement for purchasers of restaurant. Sellers misrepresented true sales amounts and inflated purchase price of the business.

 

Mason v. Sorrento Networks:

Breach of Employment Agreement

Favorable six-figure settlement for employee who was not paid his fees under a Consulting Agreement. Employer stopped paying Plaintiff claiming that Plaintiff did not execute a Proprietary Information and Inventions Agreement. Plaintiff maintains that he was not required to sign one. Due to employer’s breach of the Consulting Agreement, Plaintiff was entitled to accelerate all payments called for by the contract.
